TERMS & CONDITIONS

This agreement (the "Contract") is made between Hannah Carter Photography LLC (referred to as "Photographer") and the client (referred to as "Client") for photography services as outlined below:

 

Services

Hannah Carter Photography LLC agrees to provide professional photography services as discussed and agreed upon with the Client. The specific details, including the date, time, location, and duration of the photography session, will be mutually agreed upon in writing or via email.

 

Payment

A 50% non-refundable deposit is required to secure the photography date and time. The remaining balance is due 24 hours in advance of the photography session. Payment may be made via Credit Card, Apple Pay, and Tap. Prior written approval must be received for other forms of payment. The Photographer remains the right to cancel a session if the remaining balance is not paid within 24 hours of the agreed session. The Client will forfeit their deposit. 

 

Cancellation and Rescheduling

In the event the Client need to cancel or reschedule the photography session, please refer to the following

  • Cancelling More than 48 Hours in Advance - The Client will need to notify the Photographer via Email as soon as possible. The deposit is non-refundable and the Client forfeits rescheduling their session to a future date. If the Client has paid more than the deposit, the Photographer will try and reschedule the session with a New Client. In the event, the Photographer is unable to reschedule with a New Client, the Client agreeing to this invoice will lose any remaining balance paid.

  • Cancelling Less than 48 Hours in Advance - I understand life happens. In the event the Client cancels less than 48 hours in advance, the Client will need to notify the Photographer via Phone and Email. The Client will be responsible for the remaining balance on the invoice. The Client forfeits the right to reschedule at a later date. This includes cancelling a session due to weather.

  • Rescheduling More Than 48 Hours in Advance - The Client will need to notify the Photographer via email as soon as possible. The Photographer and Client will work together to find a new mutually agreed date and time for a new session. The deposit will be held for up to 1 year to this original invoice for the Client and Photographer to reschedule. The Client agrees that the pricing of the Photographer may increase and acknowledges their session price is only valid for this current invoice.

  • Rescheduling Less Than 48 Hours in Advance - Again, I understand life happens. The Client will need to notify the Photographer as soon as possible via phone and email. The Photographer will make her availability known to the Client. In the event the Client can not reschedule their session based on their availability, their deposit will be held for up to 1 year from the date of the invoice.

  • In the event the photographer has already traveled to the agreed upon session location without receiving notification from the Client, the Clients deposit is nontransferable and any remaining balance will be required to be paid by the Client . This includes rescheduling a session due to weather without previous agreement. The photographer may give leniency to clients on travel without notification based on travel proximity.

  • In the unlikely event that the Photographer cannot fulfill their obligations, a full refund of the deposit will be provided to the Client minus processing fees.

 

Rescheduling Due to Weather

In the event of inclement weather conditions that may affect the photography session, the Photographer will notify the Client of alternative options which include shooting through the rain (not including heavy rain, strong winds, and/or lighting), moving the session indoors, or rescheduling to a mutually agreed date/time (this includes moving to a sunrise session if previous sunset session or vice versa) by both Photographer and Client.

 

In the event, the Client is not available to be rescheduled, particularly during a trip or vacation, the Client's deposit will be fully transferable to a mutually rescheduled date within 1 year of the original invoice date. The Client agrees to be flexible and understanding in rescheduling the session and acknowledges that the quality of the photographs may be affected by adverse weather conditions. The safety and satisfaction of the Client are of utmost importance to the Photographer.

 

The Photographer will make every effort to provide advance notice to the Client if weather conditions are likely to affect the scheduled session. Likewise, the Client also agrees to promptly notify the Photographer if they have concerns or if they believe it is necessary to reschedule due to weather conditions. Any Florida based sessions will have a weather decision made at the time of the agreed session. Weather changes so quickly here that it is unrealistic to make a decision prior to the time of the session.

 

Ownership and Usage

Hannah Carter Photography LLC retains the copyright and ownership of all photographs taken during the session. The Client is granted a non-exclusive license to use the photographs for personal purposes. The Client agrees not to edit or alter the photographs without Hannah Carter Photography LLCs written permission. RAW images will not be provided to the client.

 

Creative Freedom for Editing

Hannah Carter Photography LLC takes great pride in the editing process, which is an essential part of our creative vision. We believe in the power of artistic expression and strive to deliver photographs that showcase your unique beauty and personality.

 

While we value your input and aim to meet your expectations, it is important to note that the Photographer has creative freedom in editing the photographs. Our editing style is carefully curated to reflect the mood, aesthetics, and artistic vision agreed upon by both parties.

 

The Photographer will exercise professional judgment in selecting and editing the photographs. This includes, but is not limited to, adjustments to color, exposure, composition, and overall enhancements to ensure a cohesive and visually stunning final product.

 

The Photographer understands the importance of delivering photographs that align with your preferences. However, variations in personal taste and individual monitor settings may affect the perception of colors and overall appearance. Therefore, the Photographer's editing style and final interpretation shall be deemed as the exclusive artistic representation of the photographs. By purchasing this service, the Client has agreed to the Hannah Carter Photography style.

 

Model Release

The Client grants Hannah Carter Photography LLC the right to use the photographs for marketing and promotional purposes, including but not limited to online portfolios, social media, website, and marketing materials.

 

Liability

Hannah Carter Photography LLC will take reasonable care to ensure the safety of individuals and equipment during the photography session. However, the Photographer will not be held responsible for any injuries, damages, or loss incurred during the session.

 

Completion Timeline

Hannah Carter Photography LLC will provide the final edited photographs within 4 weeks of the session date. The Client understands and agrees that the editing process takes time, and that the Photographer will provide the highest quality photographs within a reasonable timeframe.

 

Agreement Modification

Any changes or modifications to this Contract must be agreed upon in writing by both parties.

 

By paying for this service, the Client acknowledges that they have read and understood the terms and conditions of this Contract and agree to abide by them.
